These Terms and Conditions of Sale govern the contractual relationship between www.automotofrance.com (hereinafter referred to as “the Site”) and any individual or legal entity using the Site’s services (hereinafter referred to as “the Client”). They apply to all services offered by the Site, unless otherwise agreed in writing between the parties.
Article 1 – Purpose
The Site provides sales assistance services for vehicles, including facilitating connections between buyers and sellers upon request by a buyer. These TCS define the conditions under which these services are provided, including the billing of services.
Article 2 – Acceptance
Using the Site’s services implies full acceptance of these TCS. Any service order placed through the Site constitutes acceptance of these terms.
Article 3 – Services Offered
www.automotofrance.com offers the following services:
Article 4 – Pricing and Payment
1-Matchmaking Service Pricing: Connecting buyers and sellers is billed separately, with rates displayed on the Site or provided upon request.
2-Payment: Payment for services is due at the time of order or as otherwise agreed. All prices are quoted in euros, inclusive of all taxes (VAT).
3-Invoicing: An invoice is issued for each service provided, including matchmaking.
Article 5 – Orders
The Client places orders through the Site by following the indicated steps. All orders are binding and final once confirmed. The Client will receive an order confirmation by email. The Site reserves the right to refuse any order that does not comply with these TCS.
Article 6 – Client Obligations
The Client agrees to provide accurate, complete, and up-to-date information. They are also responsible for the legal compliance of the vehicle being sold.
Article 7 – Site Obligations
The Site commits to providing the services ordered diligently and professionally. However, it does not guarantee the sale of the vehicle or the accuracy of information provided by either party.
Article 8 – Buyer-Seller Matchmaking
Upon a buyer’s request, the Site can facilitate a connection with a seller that meets the defined search criteria. This service is billed as outlined in Article 4. The Site acts solely as an intermediary and assumes no responsibility for the final terms of the transaction.
Article 9 – Liability
The Site disclaims all liability for disputes between the parties (buyer and seller), including but not limited to:
Article 10 – Withdrawal Right
In accordance with legal provisions, the Client has a 14-day withdrawal period, except for services fully executed before the end of this period with the Client’s consent.
Article 11 – Personal Data Protection
Personal data collected is processed in accordance with the Site’s privacy policy. It is used exclusively for service provision purposes.
Article 12 – Intellectual Property
All content on the Site (text, images, logos, etc.) is protected by intellectual property rights and may not be used without prior authorization.
Article 13 – Force Majeure
The Site shall not be held liable for any failure to perform due to force majeure events (strike, natural disaster, pandemic, etc.).
Article 14 – Disputes and Governing Law
In case of a dispute, the parties agree to seek an amicable solution before pursuing legal action. Failing that, the competent courts shall be those in the jurisdiction of the company’s registered office. French law shall apply.
Article 15 – Modification of the TCS
www.automotofrance.com reserves the right to modify these TCS at any time. The new TCS will be applicable as soon as they are published on the Site.
